Denouncement channel

In application of Law 2/2023 of February 20, regulating the protection of people who report regulatory infractions and the fight against corruption, BIOSURYA, S.L has enabled:

• An internal denouncement channel.

• A policy, which includes the fundamental principles of the system.

• A management procedure for the internal information system.

• A body responsible for the internal information system.

What is the internal information channel?

It is the means for people with an employment or professional relationship to directly report to BIOSURYA, S.L about serious or very serious infractions that are related to the company’s own activity.

It allows the presentation and subsequent processing of anonymous communications, if the reporting person so decides. The internal channel guarantees confidentiality and data protection, preventing access by unauthorized personnel. It also allows the protection guarantees for the informant, provided for in Law 2/2023.

What types of information or complaints can be submitted?

The information processed must be limited to alleged actions that infringe the legal system, seriously or very seriously, within the scope of the company’s powers, obtained in an employment or professional relationship.

It is not an appropriate channel to request information or present claims, complaints or suggestions.

How is the internal information channel used?

The internal denouncment channel allows communications to be made in writing, through a form or verbally, through a voice file, or both. 

At the request of the informant, it may also be presented through a face-to-face meeting. In that case, the reported communications must be documented (by recording or complete transcription, with prior consent of the informant, who will have the opportunity to verify, rectify and accept the content.

External information channels are available to report the commission of any actions or omissions included in the scope of application of Law 2/2023, to the Independent Authority for the Protection of Informants, A.A.I., to the corresponding authorities or autonomous bodies, and , where applicable, to EU institutions, bodies or agencies.

Basic information on data processing 

Responsible: BIOSURYA, S.L

Purpose: collection and processing of personal data that, if applicable, are provided in the complaint, with the purpose of processing, investigating and/or resolving the corresponding communications of irregularities or complaints of non-compliance with current legislation.

Legitimation: (1) consent, (2) compliance with Law 2/2023, of February 20, regulating the protection of people who report regulatory infractions and the fight against corruption; and (3) legitimate interest of BIOSURYA, S.L in complying with the requirements regarding legal and regulatory compliance, especially those related to the possible criminal liability of the legal entity.

Recipients: Your data may be transferred to third parties exclusively in the case of professional experts for the resolution of criminal complaints, in order to safeguard confidentiality as much as possible and promote the use of this channel.

Exercise of rights: at biosurya@biosurya.com attaching a photocopy of your ID or identification document. If you do not see the exercise of your rights attended to, you can file a claim with the Spanish Data Protection Agency.
